ALL and any goods sold (hereinafter referred to as “the goods”) by Blank Media CC (hereinafter referred to as “the Seller”) shall be sold to the purchaser (hereinafter referred to as “the Purchaser”), who shall purchase such goods, subject to the terms and conditions set out hereunder:
1. Blank Media is a business in the import/export media and gifting industry that sells blank disc media, USB’s and promotional items. We also offer branding services for these products, and other adhoc products.
2. Online orders constitute a binding contract and are legally enforceable.
3. The Purchaser must pay in advance prior to the dispatch of the goods. All payments must be verified and cleared by Blank Media before goods are released to the customer, or their agent. All payments for the goods purchased shall be made in advance either by:
a) offline by Electronic Funds Transfer (EFT), or
b) offline via cash or card instore or
c) offline via cash deposits or ATM deposits
d) online via Visa and MasterCard and other options offered by a third party payment gateway
Any printed/branded or customised items will require a 50% deposit payment for production to begin, and balance on or before collection or release to courier. All goods must be paid in full prior to the dispatch of the goods. For any goods manufactured/produced and not paid in full 30 days after placing an order, we reserve the right to sell or reuse the goods to defray any expenses/costs, and the Seller will have no claims thereof.
4. Card transactions will be acquired for Blank Media via PayGate (Pty) Ltd. PayGate is a PCI DSS Level 1 Service Provider and no card details are stored on the website. Users may go to https://www.paygate.co.za to view their security certificate and security policy.
5. All transactions are applicable to 15% VAT which is displayed during checkout process.
a) A pro-forma invoice with the full amount inclusive of VAT will be emailed to you if you will be doing an offsite payment or
b) The final total with VAT will be displayed at checkout if doing an online payment.
Please note orders are only processed during working hours Monday to Friday excluding Saturdays, Sundays and public holidays.
6. Customer details will be stored by Blank Media separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to https://www.paygate.co.za.
7. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
8. Subject to availability and receipt of payment, requests will be processed within 1-3 working days and delivery confirmed by way of tracking number if a courier delivery is requested, or email confirmation if collection is requested.
9. All offsite payment orders placed on the website will be cancelled if no payment is received within 5 (five) days from the Purchaser placing the order, unless otherwise arranged.
10. Cancellation of any and all branded orders by the Purchaser will attract a 100% administration fee.
11. Every reasonable effort is made to ensure that the advertised content on the Seller’s website is accurate and current stock quantities of all items are correct at the time of your purchase, invoice, enquiry and /or order. However Blank Media does not guarantee that the items on this website are available in stock. Even if Blank Media’s website said that stock is available, we take no responsibility to the claim thereof. If goods have become sold out or unavailable for any reason during the process of a Purchaser receiving a proforma invoice or order number or making a payment (online or offline), the Purchaser shall be notified and any and all amounts will be refunded to the Purchaser. In the event that a refund is due to a Purchaser, the Purchaser shall furnish Blank Media with the Purchaser’s bank details to enable Blank Media to effect payment of the refund within 2-5 working days.
12. Although all efforts are made to ensure the advertised pricing on the Seller’s website is accurate, if however the products are offered at an erroneous price, the Seller shall not be obliged to supply the said product at the incorrect price nor be liable for any resulting losses or damages to the Purchaser. Prices and quantities published on the Sellers website are not guaranteed and subject to change without prior notice.
13. The actual colours and sizes of products may vary slightly from displayed items on this website, advertising material or represented in our catalogue. It is highly suggested that a sample be purchased for accurate colour and size – checking purposes.
14. In the event that the delivery of any goods is delayed, hindered, prevented or interfered with by any circumstances or events not caused by Blank Media or its agents, Blank Media and its agents shall not be liable to the Purchaser for any direct or indirect loss or damage caused thereby. Turnaround and lead times are only an indication of a time frame and not confirmed ready/collection dates. Unforeseen delays can occur although Blank Media will endeavour to meet all the Purchasers time frames. Branding and delivery lead times are in effect, the working day after artwork approval and full payment has been received. Amendments made to layouts will result in a delay to delivery date.
15. In the event that Blank Media is for any reason whatsoever unable to supply any item or items comprising the goods, Blank Media shall not be liable to the Purchaser for any direct or indirect loss or damage.
16. We recommend and suggest using our online delivery service provider, however should you wish to arrange collection using you own couriers, please do not send through your couriers to collect until you have received a ready for collection notification from Blank Media. Please ensure your courier knows who they are collecting for and how many orders they are collecting. It is not our responsibility to print out or complete any waybills / details for your courier. Once a courier signs acceptance for your parcels and the parcels are released from the Seller’s stated point of dispatch, the risk of loss or damage in the products shall pass to the Purchaser.
Should Blank Media or its agents deliver to your delivery address and there is no one available to accept the delivery (either yourself or a representative), Blank Media will be entitled to charge for the second delivery or can request that you, the Purchaser, collect the goods.
17. Regretfully Blank Media does not allow any refunds or returns unless authorized by the discretion of Blank Media Management, subject to a 20% handling charge. The Purchaser will need to bring any requests for refunds or returns to the attention of Blank Media within 48 hours of acquiring the goods. Please do not return orders without prior written consent from the Seller’s Management. Any orders returned must be done so at your own expense directly to our offices in Edenvale, Johannesburg. No branded or customised goods will be refunded or exchanged under any circumstances.
18. Please note none of the items sold on our website carry a guarantee or warranty, and Blank Media will not be held responsible for any direct or indirect damages or loss of any kind. Once an order for any memory sticks has been collected from us, we unfortunately cannot accept a return on it. Any opened packs of discs, we unfortunately cannot accept a return on it. If a need arises for a return at the Seller’s discretion, the return will not be refunded, however either exchanged or credited to the Purchasers Blank Media account for use on future purchases.
19. Blank Media takes no liability if the incorrect goods are purchased. Please ensure you have chosen the correct products and the correct quality grade.
20. The Purchaser warrants and declares that it/he/she holds the appropriate authority to order, purchase and /or distribute products containing names, logos, copyrights and/or trademarks and/or other necessary permissions for all material supplied to the Seller. The Seller will not be held liable for any copyright and/or trademark disputes. The Purchaser also agrees to indemnify, defend, and hold harmless the Seller, its affiliates and representatives from and against all claims, liabilities, and expenses (including attorney fees) arising out of or related to an actual infringement or misappropriation of any trademark, copyright or any other proprietary right of such merchandise/products. This provision will remain in effect even after the deliver of your order.
21. Blank Media takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
22. This website is governed by the laws of South Africa and Blank Media chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
23. Blank Media may, in its sole discretion, change this agreement or any part thereof at any time without notice.
24. Blank Media reserves the right to refuse the supply of goods or services to anyone, at any time, for any reason.
