ALL and any goods sold (hereinafter referred to as \u201cthe goods\u201d) by Blank Media CC \u00a0(hereinafter referred to as \u201cthe Seller\u201d) shall be sold to the purchaser (hereinafter referred to as \u201cthe Purchaser\u201d), who shall purchase such goods, subject to the terms and conditions set out hereunder:<\/p>\n
1. \u00a0Blank Media is a business in the import\/export media and gifting industry that sells blank disc media, USB\u2019s and promotional items.\u00a0 We also offer branding services for these products, and other adhoc products.<\/p>\n
2. \u00a0Online orders constitute a binding contract and are legally enforceable.<\/p>\n
3. \u00a0The Purchaser must pay in advance prior to the dispatch of the goods. All payments must be verified and cleared by Blank Media before goods are released to the customer, or their agent.\u00a0 All payments for the goods purchased shall be made in advance either by:<\/p>\n
a) offline by Electronic Funds Transfer (EFT), or<\/p>\n
b) offline via cash or card instore or<\/p>\n
c) offline via cash deposits or ATM deposits<\/p>\n
d) online via Visa and MasterCard and other options offered by a third party payment gateway<\/p>\n
Any printed\/branded or customised items will require a 50% deposit payment for production to begin, and balance on or before collection or release to courier. \u00a0All goods must be paid in full prior to the dispatch of the goods. \u00a0For any goods manufactured\/produced and not paid in full 30 days after placing an order, we reserve the right to sell or reuse the goods to defray any expenses\/costs, and the Seller will have no claims thereof.<\/p>\n
4. \u00a0Card transactions will be acquired for Blank Media via PayGate (Pty) Ltd. \u00a0PayGate is a PCI DSS Level 1 Service Provider and no card details are stored on the website. Users may go to https:\/\/www.paygate.co.za to view their security certificate and security policy.<\/p>\n
5. \u00a0All transactions are applicable to 15% VAT which is displayed during checkout process.<\/p>\n
a) A pro-forma invoice with the full amount inclusive of VAT will be emailed to you if you will be doing an offsite payment or<\/p>\n
b) The final total with VAT will be displayed at checkout if doing an online payment.<\/p>\n
Please note orders are only processed during working hours Monday to Friday excluding Saturdays, Sundays and public holidays.<\/p>\n
6. \u00a0Customer details will be stored by Blank Media separately from card details which are entered by the client on PayGate\u2019s secure site. For more detail on PayGate refer to\u00a0https:\/\/www.paygate.co.za<\/a>.<\/p>\n 7. \u00a0The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).<\/p>\n 8. \u00a0Subject to availability and receipt of payment, requests will be processed within 1-3 working days and delivery confirmed by way of tracking number if a courier delivery is requested, or email confirmation if collection is requested. You may place an order for certain products that are currently out of stock, these items will be placed on back order. Items on back order typically ship within 3-10 working days.<\/p>\n 9. \u00a0All offsite payment orders placed on the website will be cancelled if no payment is received within 5 (five) days from the Purchaser placing the order, unless otherwise arranged.<\/p>\n 10. \u00a0Cancellation of any and all branded orders by the Purchaser will attract a 100% administration fee.<\/p>\n 11. \u00a0Every reasonable effort is made to ensure that the advertised content on the Seller\u2019s website is accurate and current stock quantities of all items are correct at the time of your purchase, invoice, enquiry and \/or order. \u00a0However Blank Media does not guarantee that the items on this website are available in stock. \u00a0Even if Blank Media\u2019s website said that stock is available, we take no responsibility to the claim thereof.\u00a0 If goods have become sold out or unavailable for any reason during the process of a Purchaser receiving a proforma invoice or order number or making a payment (online or offline), the Purchaser shall be notified and any and all amounts will be refunded to the Purchaser.\u00a0 In the event that a refund is due to a Purchaser, the Purchaser shall advertised pricing on the Seller\u2019s website is accurate, if however the products are offered at an erroneous price, the Seller shall not be obliged to supply the said product at the incorrect price nor be liable for any resulting losses or damages to the Purchaser. \u00a0Prices and quantities published on the Sellers website are not guaranteed and subject to change without prior notice.<\/p>\n 13. \u00a0The actual colours and sizes of products may vary slightly from displayed items on this website, advertising material or represented in our catalogue. \u00a0 It is highly suggested that a sample be purchased for accurate colour and size \u2013 checking purposes.<\/p>\n 14.\u00a0In the event that the delivery of any goods is delayed, hindered, prevented or interfered with by any circumstances or events not caused by Blank Media or its agents, Blank Media and its agents shall not be liable to the Purchaser for any direct or indirect loss or damage caused thereby. \u00a0Turnaround and lead times are only an indication of a time frame and not confirmed\u00a0<\/span>ready\/collection dates. \u00a0<\/span>Unforeseen\u00a0delays can occur although Blank Media will endeavour to meet all the Purchasers time frames. \u00a0<\/span>Branding and delivery lead times are in effect, the working day after\u00a0<\/span>artwork approval and full payment has been received. \u00a0Amendments made to layouts will result in a delay to delivery date.<\/p>\n 15. \u00a0In the event that Blank Media is for any reason whatsoever unable to supply any item or items comprising the goods, Blank Media shall not be liable to the Purchaser for any direct or indirect loss or damage.<\/p>\n 16. \u00a0We recommend and suggest using our online delivery service provider, however should you wish to arrange collection using you own couriers, please do not send through your couriers to collect until you have received a ready for collection notification from Blank Media. \u00a0Please ensure your courier knows who they are collecting for and how many orders they are collecting. \u00a0It is not our responsibility to print out or complete any waybills \/ details for your courier. \u00a0Once a courier signs acceptance for your parcels and the parcels are released from the Seller\u2019s stated point of dispatch, the risk of loss or damage in the products shall pass to the Purchaser.<\/p>\n Should Blank Media or its agents deliver to your delivery address and there is no one available to accept the delivery (either yourself or a representative), Blank Media will be entitled to charge for the second delivery or can request that you, the Purchaser, collect the goods.<\/p>\n 17. \u00a0Regretfully Blank Media does not allow any refunds or returns unless authorized by the discretion of Blank Media Management, subject to a 20% handling charge. \u00a0The Purchaser will need to bring any requests for refunds or returns to the attention of Blank Media within 48 hours of acquiring the goods. \u00a0Please do not return orders without prior written consent from the Seller\u2019s Management. \u00a0Any orders returned must be done so at your own expense directly
